Relaxation from Strict Enforcement of SEBI (Foreign Portfolio Investors) Regulations, 2019

SEBI is now permitted to grant relaxation from strict enforcement of any of the provisions of the SEBI (Foreign Portfolio Investors) Regulations, 2019 (“FPI Regulations”) pertaining to Foreign Portfolio Investors (“FPI”), either suo motu or upon an application made by the FPI, in case of the following events:
- If the non-compliance of the FPI Regulations is caused due to factors beyond the control of the entity; or
- If the compliance requirement is procedural or technical in nature.
The aforementioned relaxation would be subject to the conditions imposed by SEBI.
Application Process
FPIs may apply for relaxation from strict enforcement of FPI Regulations, along with payment of a non-refundable application fee of USD 1,000, to SEBI.
